Hearing officers have consistently held that under the stay-put rule, a student remains in their then-current educational placement while a dispute is pending.1 The protection attaches automatically once an IEP is rejected in whole or in part, and continues even when a hearing request is filed.2 Massachusetts BSEA hearing officers enforce it consistently, but there are exceptions, including once a student graduates or ages out, or if there is a prior agreement.3
