Yes, and in Massachusetts the stay-put right attaches from the moment a parent rejects a proposed IEP or placement, in whole or in part, whether or not a hearing request has been filed. 603 CMR 28.08(7) provides that during the pendency of any dispute over placement or services, the student remains in their then-current program and placement unless the parents and district agree otherwise.1 In Uxbridge Public School, parents rejected the district's finding that their child was no longer eligible for special education but had not yet filed a hearing request or appeal. The hearing officer held that the Massachusetts stay-put regulation is triggered by any dispute over services or placement, not only by a filed due process appeal, and ordered Uxbridge to immediately resume the student's stay-put services and placement.2
